Customs exemptions

The Decree of the President of the Republic of Uzbekistan “On Additional Measures to Support the Service Sector” No. PD-6318 dated 30.09.2021 extends until 1.01.2024 the customs duty exemptions for certain types of goods and vehicles imported into the territory of the Republic of Uzbekistan (hereinafter – “Uzbekistan”), including:

  • for new medical equipment, components, spare parts and consumable materials for medical equipment imported by business entities, including under leasing agreements and the list formed pursuant to the Resolution of the Cabinet of Ministers of Uzbekistan No.356 dated 31.12.2013;
  • for new ambulances imported by non-governmental medical organizations for their needs.

Certain types of licenses are abolished

On 12.10.2021 the President of Uzbekistan signed the Law “On Amendments and Additions to Some Legislative Acts of the Republic of Uzbekistan in connection with the Adoption of the Law of the Republic of Uzbekistan “On Licensing, Permitting and Notification Procedures” No.721. Among other things, the Law of Uzbekistan “On Medicines and Pharmaceutical Activities” No.415-I dated 25.04.1997 (as amended by the Law of Uzbekistan No.399 dated 4.01.2016) was amended to exempt the following types of pharmaceutical activities from the licensing requirement:

  • manufacturing, production, wholesale of medical products;
  • research work on the creation of medicines and medical products;
  • quality control of medicines and medical products;
  • packaging and wholesale of medicinal plant raw materials.

Additionally, business entities that have license for the retail sale of medicines and medical products are no longer required to notify the Agency for the Development of the Pharmaceutical Industry under the Ministry of Healthcare of Uzbekistan to carry out activities for the retail sale of ophthalmic medical devices (optics).

The list of state audits is expanded

The Decree of the President of Uzbekistan “On Amendments and Additions to Certain Acts of the President of the Republic of Uzbekistan” No. PD-6263 dated 17.07.2021 supplemented the List of audits carried out by notifying the authorized body through the registration in the Unified System of Electronic Registration of Audits (hereinafter – the “List”). The List was initially approved by the Decree of the President of Uzbekistan “On Measures to Further Improve the System of Protection of the Rights and Legitimate Interests of Business Entities” No. PD-5490 dated 27.07.2018.

Additional types of state audits carried out subject to the notification of the Commissioner for Protection of Rights and Legitimate Interests of Entrepreneurs under the President of Uzbekistan from 1.11.2021 are:

  • control over the compliance by business entities and individuals with the requirements of regulatory documents in the field of technical regulation in the following areas;
  • road construction;
  • manufacturing road-building materials, products and structures;
  • control over:
  • illegal connection to water supply and sanitation systems;
  • intentional damage to metering devices;
  • interference with metering devices from the outside in order to change their indicators;
  • potable water supply and sewerage companies’ compliance with the rules of service in the field of water supply and sewerage.

Tightening the liability for violation of personal data legislation

The President of Uzbekistan signed the Law of Uzbekistan “On Amendments and Additions to Certain Legislative Acts of the Republic of Uzbekistan” No. 726 dated 29.10.2021, which provides for tightening of liability for violation of legislation on personal data (hereinafter – the “PD”):

  • Illegal processing of the PD and non-compliance with the requirements for processing of the PD of citizens of Uzbekistan in terms of collection, storage and systematization on technical media physically located on the territory of Uzbekistan entails the fine:
  • on citizens - in the amount of 7 (seven) specified base values[1] (hereinafter – “SBV”);
  • on officials - in the amount of 50 (fifty) SBV.
  • In case of repeated violation within a year after the application of the administrative penalty, the following penalties apply:
  • a fine of up to 150 (one hundred and fifty) SBV;
  • deprivation of a certain right for up to 3 (three) years or community service for up to 2 (two) years.

The changes will come into force on 30.01.2022.

However, enforcement of requirements of localization in Uzbekistan of servers of foreign business entities engaged in processing of the PD of citizens of Uzbekistan remains uncertain[2].
